在9月份吕耿松的案件就由杭州市公安局国保支队直接负责了，西湖区公安分局根本就
没有任何自主权。西湖区国保的主要职能仅仅是尽可能封锁案件信息，并千方百计以无
理耍赖方式阻挠莫少平律师会见吕耿松。
11月28日杭州市公安局国保支队将吕耿松的案卷移交给杭州市检察院。莫少平律师的助
理丁锡奎律师29日下午直接联系杭州市公安局和杭州市检察院，并基本确定下周前往杭
州申请会见吕耿松。如果得以会见，将是这起维权案件中的基础性突破。从此前获得的
信息中证实，吕耿松本人一直有强烈的意愿聘请律师。鉴于当局构陷吕耿松的罪名为涉
嫌”煽动颠覆国家政权”，所以根本不存在涉密问题，而浙江省政法委、浙江省公安厅
国保总队和杭州市公安局国保支队，一直是采取中国国保政治警察系统惯用的既违法且
无赖的方式来阻挠律师会见。令国内人士和国际社会所不齿。杭州这座美丽的城市也因
为浙江当局疯狂镇压异议人士而蒙上了污点。

吕 耿 松 涉 嫌 煽 动 颠 覆 国 家 政 权 一 案

我们是北京莫少平律师事务所的莫少平、丁锡奎律师。2007年8月29日我们接受犯罪嫌
疑人吕耿松之女吕飘旗的聘请，担任吕耿松的律师。
吕耿松于2007年8月24日被杭州市公安局西湖区分局（以下简称西湖分局）以涉嫌”煽
动颠覆国家政权罪”、”非法持有国家机密罪”刑事拘留；我们于9月11日通过特快专
递向西湖分局递送了有关律师聘请及会见手续。然而西湖分局却于9月14日向吕飘旗出
具了西公刑密聘字〔2007〕1号《涉密案件聘请律师决定书》，决定不准予聘请律师。
我们认为西湖分局的做法是不符合相关法律规定的，遂于9月26日致函（《律师函》附
后）西湖分局，据理交涉；
2007年9月29日，经杭州市人民检察院批准，贵局以涉嫌”煽动颠覆国家政权罪”
（注：已没有涉嫌”非法持有国家机密罪”）逮捕了吕耿松；10月10日，我们再次通过
特快专递向西湖分局递交会见手续和取保候审申请；10月16日，西湖分局仍以”涉及国
家秘密”为由不准予聘请律师；
为此我们提出如下律师意见，供参考：
一、根据《最高人民法院最高人民检察院公安部国家安全部司法部全国人大常委会法制
工作委员会关于刑事诉讼法实施中若干问题的规定》第９条
“刑事诉讼法第 九十六条
规定的’涉及国家秘密的案件’，是指案情或者案件性质涉及国家秘密的案件，不能因
刑事案件侦查过程中的有关材料和处理意见需保守秘密而作为涉及国家秘密的案件”的
规定，我们认为，本案不应当被认定为”涉及国家秘密的案件”，理由是：
1、根据《中华人民共和国刑法》第一百零五条第二款规定，关于”煽动颠覆国家政权
罪”是指，以造谣、诽谤或者其他方式煽动颠覆国家政权、推翻社会主义制度的行为；
而造谣、诽谤等都是一种公开实施的行为，既是”公开实施” 的行为，就无”秘密”
可言。
2、《现代汉语词典》关于”煽动”的词义解释为：鼓动（用语言、文字等激发人们的
情绪，使他们行动起来）别人去做坏事。故所谓”煽动”，必须公开来进行，必须有诸
多不特定的受众，秘密的行为不可能构成煽动。
综上，从”煽动颠覆国家政权罪”的性质来讲，该罪不可能成为”涉及国家秘密”的案
件。西湖分局以”涉及国家秘密”为由拒绝吕耿松的亲属聘请律师，从法理上讲，是不
可能成立的；同时，这也无形中剥夺了吕耿松在侦查阶段获得律师帮助的权利。
二、关于郑国良的情况反映
据吕耿松先生的亲属讲，西湖分局国保大队长郑国良亲口对她说，”（吕飘旗为其父聘
请的律师）那两个律师是惟恐天下不乱的，所以不能聘请”。为此，我们在9月26日给
西湖分局的《律师函》明确指出：请西湖分局调查核实，如果属实，我们认为郑国良警
官的行为是有违人民警察的行为规范和职业准则的，也是极不负责任的，并保留依法追
究郑国良警官对我们进行诽谤的法律责任的权利。但西湖分局至今未给我们明确回复；
故我们在此恳请贵局，做为西湖分局的直接上级，对上述事实进行核实；而且，我们认
为以郑国良目前的状况（据亲属讲郑国良对本案有相当大的抵触情绪），不宜再继续参
与本案的侦查工作，应予回避，以保证本案侦查的公正进行。
据了解，本案得到了国内外媒体及有关方面的广泛关注，望贵局公正执法，严格遵守法
定程序，以树立我国司法机关的良好的正面形象。请贵局尽快妥善处理吕耿松聘请律
师、会见律师及取保候审的问题。
